The amendment of the German Renewable Energy Sources Act (EEG) beginning from 2012 is settled matter. The most important statutory provisions are inter alia grandfather rights in favor of existing installations and an additional level in the engine-power class of 750 kW. As expected, the feed-in-tariffs for electricity generated will be reduced.

Our law firm was engaged by RKW Thüringen GmbH and RKW Sachsen GmbH to take action against a competitor who had used our clients' company name as an adword. This meant that if you typed 'RKW Thüringen' or 'RKW Sachsen' into the search engine, the competitor's advertisement would appear at the beginning of the list of search results. The advertisement itself was again headed with the company names 'RKW Thüringen' or 'RKW Sachsen'. Users were referred to the competitor's Internet site only at the end of the advertisement.
